1. Scope

The following General Terms and Conditions (GTC) apply to all orders placed via our website.

A consumer is defined as a natural person who maintains a business relationship with Sooray that cannot be attributed to their commercial or independent professional activity. Orders in quantities exceeding normal household quantities may be rejected without justification.  

Sooray reserves the right to change these Terms and Conditions at any time. The version of these Terms and Conditions applicable at the time of the order shall prevail, and cannot be unilaterally changed for that order. Customer terms and conditions that conflict with or deviate from these Terms and Conditions will not be recognized.

2. Information on this website

Sooray provides information about products and services. Price and product range changes, as well as technical modifications, are subject to change. All information on www.sooray.com (product descriptions, images, illustrations, films, dimensions, weights, technical specifications, accessory relationships, and other information) are for illustrative purposes only and are to be understood as approximate values. They do not constitute any assurance of properties or guarantees unless expressly stated otherwise. Sooray endeavors to provide all information on this website as correct, complete, up-to-date, and clear; however, Sooray makes no express or implied warranty in this regard.

All offers on this website are subject to change and are not to be understood as binding offers.

Sooray cannot guarantee that the listed products will be available at the time of order. Therefore, all information regarding availability and delivery times is subject to change at any time and without notice.

3. Prices

The sales prices listed on Sooray are final prices and, unless otherwise stated, include statutory value-added tax and any other statutory fees such as advance recycling fees (ARG) or copyright fees for electronic devices. Prices are net and in Swiss francs (CHF).

Unless otherwise stated, any shipping costs will be charged additionally and are to be paid by the customer. Shipping costs are shown separately during the ordering process.

Technical changes, errors, and misprints are reserved. Sooray reserves the right to make price changes at any time and without prior notice. Sales prices do not include consulting and support services.  

4. Conclusion of contract

The products and prices on this website are non-binding offers.

By placing an order through this website, including acceptance of these Terms and Conditions, the customer submits a legally binding offer to conclude a contract. Sooray will then send an automatic order confirmation via email, confirming that Sooray has received the customer's offer. Placed orders are binding for the customer. Unless otherwise stated, there is no right of return or refund. Right of withdrawal.  

The contract is concluded as soon as Sooray sends an acceptance declaration by email confirming the dispatch of the ordered products or services. 

Orders will only be shipped after full payment has been received (except for delivery against invoice) and provided the goods are available. If it becomes apparent that the ordered goods cannot be delivered or cannot be delivered in full, Sooray reserves the right not to accept or fulfill the order or to accept or fulfill it only partially. In such a case, Sooray will notify the customer by email. If Sooray has already received the customer's payment, the payment will be refunded. If no payment has been made yet, the customer is released from the payment obligation.     

5. Payment options and retention of title

The customer has access to the payment options specified during the ordering process.

Sooray reserves the right to exclude customers from certain payment options or to insist on payment in advance without giving reasons.

Sooray In the event of late payment by the customer, the Bank may charge default interest of 5% per year and a reminder fee of up to CHF 20 per reminder.

The products delivered to the customer remain the property of Sooray until full payment has been made . 

6. Delivery, obligation to inspect, notification of defects and return

Deliveries will be sent by post or courier to the address provided by the customer in the order.

Sooray Sooray strives to keep delivery times as short as possible. However, the delivery times stated in the order confirmation are non-binding. Sooray reserves the right to make partial deliveries. In this case, the shipping costs will be charged to the customer only once.  

The invoice, if delivery against invoice is offered, will be sent by email or post at Sooray 's discretion.  

If the delivery cannot be made or if the customer refuses to accept the delivery, Sooray may terminate the contract after notifying the customer by email and observing a reasonable grace period and charge the customer for the costs of the effort.  

The customer is obliged to inspect the delivered goods immediately upon receipt of delivery and to report any defects for which Sooray is liable by email in the imprint, including a video demonstration of the defects.   

Returns to Sooray are at the customer's expense and risk. The customer must return the goods in their original packaging, complete with all accessories, along with the delivery note and a detailed description of the defects. Returns must be reported by email so that we can review the case individually and provide the return address.  

If Sooray 's inspection reveals that the goods do not have any detectable defects or that they are not covered by the manufacturer's warranty, Sooray may charge the customer for the costs of returning the goods or any disposal.

7. Right of withdrawal

The customer is granted a right of withdrawal within 14 calendar days of the order date. This period is deemed to have been met if the customer sends the written cancellation to Sooray by email or letter within the deadline . For a justified cancellation, Sooray will charge the buyer a processing fee of CHF 20.00.   

Exercising the right of withdrawal will result in a reversal of the contract. The customer must return the goods to Sooray within 10 calendar days in their original packaging, complete with all accessories, and along with the delivery note . Returns must be reported by email so that we can review the case individually and, if necessary, provide the return address. Returns to Sooray are at the customer's expense and risk. Any payment already made will be refunded to the customer within 30 calendar days, provided Sooray has already received the goods back or the customer can provide proof of shipment.

Sooray reserves the right to demand appropriate compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the loss in value from the purchase price already paid or to invoice the customer.

No right of withdrawal is granted in the following cases:

• If the contract has an element of chance, in particular because the price is subject to fluctuations, the provider has no influence;
• If the contract concerns a movable item which, due to its nature, is not suitable for return or is liable to deteriorate quickly;
• If the contract concerns a movable item that is manufactured according to the customer's specifications or is clearly tailored to personal needs;
• If the contract concerns digital content and this content is not made available on a fixed medium or if the contract is to be performed in full immediately by both parties;
• If the contract is for the provision of services and the contract is to be fully performed by the provider with the prior express consent of the customer before the withdrawal period has expired.
• In the areas of accommodation, transport, supply of food and beverages and leisure activities, where the provider undertakes, at the time of conclusion of the contract, to provide the services at a specific time or within a precisely specified period.

8. Warranty

Sooray has endeavored to deliver goods of impeccable quality. For defects reported in a timely manner, Sooray guarantees the freedom from defects and functionality of the item purchased by the customer for the statutory warranty period, which is generally two years from the delivery date. It is at Sooray 's discretion to fulfill the warranty through free repair, equivalent replacement, or refund of the purchase price. Further warranty claims are excluded.    

The warranty does not cover normal wear and tear, the consequences of improper handling or damage, or defects resulting from extreme circumstances. Likewise, the warranty does not cover consumables and wear parts (e.g., batteries, rechargeable batteries, etc.).

Sooray It is not possible to provide any assurances or guarantees regarding the timeliness, completeness, and accuracy of the data, nor for the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks, and other content. In particular, no assurances or guarantees are made that the use of the website will not infringe the rights of third parties not owned by Sooray .

Sooray excludes all liability, regardless of its legal basis, as well as claims for damages against Sooray and any vicarious agents and agents. In particular, Sooray is not liable for indirect damages and consequential damages, lost profits, or other personal injury, property damage, or purely financial loss suffered by the customer. Further mandatory statutory liability, for example, for gross negligence or unlawful intent, remains reserved.    

Sooray Hyperlinks are used solely to simplify customer access to other websites. Sooray cannot know the detailed content of these websites, nor can it assume liability or other responsibility for the content of these websites.  

10. Data protection

Sooray may process and use the data collected during the conclusion of the contract to fulfill the obligations arising from the purchase contract and for marketing purposes. The data necessary to fulfill the service may also be passed on to commissioned service partners (logistics partners) or other third parties.

11. Partial invalidity

Should individual provisions of these Terms and Conditions prove to be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

12. Further provisions

Sooray expressly reserves the right to change these General Terms and Conditions at any time and to put them into effect without notice.

In the event of any dispute, Swiss substantive law shall apply exclusively, excluding any conflict of law provisions. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is expressly excluded.  

The place of jurisdiction is Berikon or the place of residence of the consumer .
